"State legislation has been introduced to strip localities of our authority over siting, installation, and permitting of small cell facilities. Senator Middleton, the chair of the finance committee, is sponsoring the bill in the Senate (SB1188). Delegate Derek Davis, chair of the house economic matters committee, is sponsoring the bill in the house (HB1767). It is a top priority of MML to oppose this, and I think it's fair to say it's a top priority of the City of Gaithersburg as well.
The Senate public hearing on the bill is March 20 at 1 pm in Annapolis. (The House hearing has not been scheduled yet.)
I am asking you all to please spread the word (on social media, email, Nextdoor, etc.) to make sure there as many residents as possible signing up to testify at the hearing, or just attending and filling the audience with opponents so the committee members can see how strongly we all oppose this bill. And to make sure that residents WRITE emails and letters to the two sponsors (and copy their committee members) expressing their opposition! The more people they see and hear from, the more likely they are to shelve this bill. Remember, it's an election year for these legislators, and we can use that to our advantage! All of the residents who have been active in this effort at the city or county level now need to turn their attention to the state government in Annapolis, so we can stop the state from totally preempting the local authority that we have under FCC rules. As we know, these residents are very passionate and willing to show up. So we need to harness that passion to oppose the state bills."
